Responsibilities include supporting PSG Floorcovering sales related strategic priorities through timely and effective execution of contracts, bids and other documents while protecting the interests and assets of the Sherwin-Williams Company through appropriate compliance and due diligence with all federal and state laws and regulations.

Because this role involves access to confidential financial information, the Company has determined that a review of criminal history is necessary to protect the business and its operations and reputation and to provide similar protections for its clients and potential investments.

Core Responsibilities

CORE RESPONSIBILITY 1:  CONTRACT AND DOCUMENT MANAGEMENT

  • Ensure all contracts, bids, vendor agreements received are processed and negotiated in a timely manner consistent with helping secure sales while protecting the interests of the Sherwin-Williams Company.
  • Ensure communication of any concerns with the terms and conditions of any documents to the appropriate level of management along with a recommendation on how to proceed towards a successful outcome.
  • Develop and maintain good working relationships with Division Management, Legal, Risk, Employee Relations and other departments to help improve the management of documents and minimize risk.
  • Explain and provide training & direction to floorcovering facilities and the field Credit/Financial organization as it pertains to the specifics in contracts e.g. prevailing wage, MBE/WBE & Section 3 requirements, invoicing requirements, AIA requirements etc.
  • Provide reporting for management as required

CORE RESPONSIBILITY 2:  DIRECT NEGOTIATION OF DOCUMENTS WITH EXTERNAL CUSTOMERS

  • Negotiate directly with external customers on contracts, bids and vendor agreements. 
  • Negotiate and track change orders to existing contracts.
  • Confirm the scope of work for a project has been reviewed and agreed to by the appropriate SW Sales/Operations Manager and qualified installers are being used.
  • As necessary communicate any concerns with the terms of any contracts, bids and other documents with the appropriate Division Controller and or Manager for final decision on whether to accept or not.
  • Act as a liaison between external customers, the SW business unit and the SW legal department.

CORE RESPONSIBILITY 3:  CONTRACT SYSTEMS, TOOLS & PROCESSES

  • Participate in Corporate initiatives as necessary and represent Contract Services interests on matters impacting contracts and other document management.

Position Requirements

Formal Education:

Required:

  • Bachelor’s Degrees in Business or a Legal Related Field
  • Juris Doctor (J.D.)

Knowledge & Experience:

Required:

  • Strong organizational, planning and time management skills are required
  • 5+ years of progressive accounting, finance, or business experience
  • Ability to read, comprehend and draft legal language and terms as it relates to contracts and other documents reviewed
  • Must be able to communicate and negotiate effectively in person, over the phone and by written/e-mail correspondence with both internal and external customers

Preferred

  • A background in legal and/or equivalent experience.

Technical/Skill Requirements:

Required:

  • Effective time management to ensure each SW entity receives the service level expected. 
  • Handling multiple tasks and negotiations at one time and meeting both internal and external customer expectations.
  • Negotiating the best possible position for SW while maintaining an acceptable turnaround time and procuring the sale.
  • Manage the workflow to meet required deadlines.
  • Provide training to select DCM’s/DFM’s with floor covering facilities on all aspects of contract work, in particular prevailing wage projects, certified payroll reviews, AIA requirements and invoicing procedures. Once trained these managers can then provide training and direction to the floor covering facilities in their area.
  • The need to be very organized and the ability to work independently with minimal direct supervision.
  • Understanding complex legal and insurance terms and issues.
  • Understand and communicate the risk to SW management as it relates to various terms and conditions of contracts, bids and other documents.

  • Basic understanding of contract legal terms and conditions
