Responsibilities:•Develop subject matter expertise on paid family and medical leave (PFML), statutory short-term disability, employment, labor and health laws and regulations at federal and state levels in states where Company is licensed. Analyze state laws, regulations and state insurance department bulletins, notices, and circular letters for impact on Company products. Provide updates, including links to or attachment of appropriate bulletins, laws or regulations, to V.P. Government Affairs and Managing Counsel, and Counsel(s). •Participate and work with state and national trade associations in industry advocacy efforts in emerging market states considering and/or implementing paid family and medical leave programs, while maintaining a presence in current market states and monitoring and reporting to the V.P. Government Affairs and Managing Counsel any legislative or regulatory changes that potentially impact said market. •Respond to legal/compliance questions from Company departments. •Build and maintain strategic relationships with industry state and national trade associations, state legislators, regulatory agencies, and key stakeholders to influence policy development and implementation.•Contribute to regulatory development by drafting comment letters, reviewing proposed regulations, and compiling feedback from internal teams.•Represent the Company at select industry events and working groups through both participation in and presentation of industry informational sessions on PFML and related government programs.•Conduct legal research and provide guidance on various compliance topics, including insurance advertising laws, regulatory filing requirements, consumer complaints, HIPAA and state privacy laws, claims adjudication, and electronic signature laws. •Attend assigned project meetings to provide oversight and identify potential compliance issues to be addressed and escalated to Managing Counsel/ Counsel(s). •Conduct regulatory research and provide legal guidance related to insurance product development, insurance compliance, forms, and filings. •Review and approve Company PFML insurance product policy forms for use after de-bracketing by Product Development and assist in the de-bracketing process. •Review PFML product advertising materials for legal accuracy and compliance with applicable laws. •Assist with general compliance matters including preparation and submission of compliance reports/data calls to requesting regulatory entities in a timely manner. •Review correspondence from outside attorneys, law firms, courts or state agencies. •Aid other Company departments in responding to inquiries. •Meet objectives and goals set forth by management.
Qualifications:•Licensed attorney in good standing in at least one U.S. jurisdiction, and eligible to practice as in-house counsel in New York State under the applicable registration rules•5 years of experience with Paid Family and Medical Leave (PMFL) or absent management, FMLA or similar technical experience.•Proven skill in translating legal and regulatory issues into actionable guidance for cross-functional teams.•Proficient in legal research, including experience with Westlaw or Lexis •Experienced in leveraging Microsoft Office Suite (Word, Excel, PowerPoint, Outlook, and Teams) for efficient document creation, collaboration, and reporting.•JD from accredited law school •Government affairs/regulatory or trade association experience with Worker’s Comp or other statutory disability and/or PFML insurance strongly preferred.
