The Senior Manager: Regulatory Affairs will be accountable to achieve the following objectives:
- Provide leadership in regulatory affairs and ensure that the business is prepared to respond to diverse issues arising from regulatory frameworks, environments and competitive markets
- Prepare policy submissions on matters involving regulatory instruments and public policy relating to the countries in which MTN operates as well as regional and global regulatory issues
- Development of regulatory strategy, issue management and power mapping frameworks
- Provide regulatory input into business strategy
- Monitoring and analysis of pending legislation and regulations that may impact the company’s operations and MTN Group, and alerts management
- Provide input into proposed regulatory policies/legislation along with the OpCos and/or platforms ensuring MTN’s Group and operational interests are taken into account
- Influence the telecommunications sector competition policies to advocate for regulatory parity
- Monitor and review regulatory issues including regulatory compliance with reference to
o interconnect agreement and all interconnect related issues affecting the business.
o infrastructure sharing guidelines/ agreements and national and international roaming agreements.
o MTN Group and Opco agreements and other arrangements impacting regulatory issues, prescriptions and policies
- Address and provide satisfactory resolutions of regulation issues pertaining to:
o the impact, proactive development of strategy relating to interconnection as they pertain to mobile operators
o analysis of international and domestic telecom pricing and cost studies for the purpose of rendering requisite support to the MTN business to determine accuracy and the resulting impact on MTN’s business goals and strategy
o market trends and conducting evaluation of data researched and identifying potential risks / threats / opportunities
o tariff analyses in both retail and wholesale markets including cost studies to establish cost-based tariffs and regulation
o keeping abreast of regulatory economics and developments in ICT competition regulation
- Provide advice and regulatory support on issues pertaining to consumer and services regulation including consumer protection issues, consumer rights, data protection, privacy and sovereignty, and products and services offered
- Monitor, review and keep MTN Group abreast of developments; bills, and new policies, within the global MTN Group and operational legislative/ regulatory arena
- Provide detailed research and benchmarking for purposes of developing MTN Group’s position in response to legislative and policy changes from time to time and providing support to OpCos and platforms in respect of their positions
- Driving industry initiatives through industry bodies and with industry stakeholders including
o Making presentations to key pertinent stakeholders’ relevant fora
o Building and maintaining relationships with key stakeholders and co-ordinating lobby efforts with the relevant stakeholders
o Assisting in negotiations with mid-level regulatory authority professionals and government stakeholders
o Supporting regulatory initiatives through engagement and relationships with key industry stakeholders and industry bodies
o Promoting the development of sensible regulatory frameworks for MTN amongst government and regulatory authorities in all markets that would lead to productivity gains
o Participating in proactive engagement with senior-level regulatory authorities, governments, stakeholders and industry fora to influence regulatory policies
- Assess impact of proposed regulatory frameworks on sustainability of business operations
- Develop mitigation strategies for issues as and when they arise
- Establish a centre of excellence for advice on regulatory matters within MTN
- Any other regulatory issues that may from time to time arise
Key Deliverables
- Business opportunities and threats presented by current and pending regulations and legislation are identified and appropriate recommendations are made
- Pertinent opinions, position papers, submissions and toolkits
- Implementation of Group Regulatory strategy including economic and service regulation
- Monitoring of licencing frameworks across the Opco’s
- Regulatory compliance to regulations and legislations
- Supporting effective capacity building interventions and self-development opportunities for regulatory affairs unit
Education:
- Law (LLB degree), or minimum 4-year Tertiary degree in Economics, Politics or International Relations
- Masters or sector-related certifications advantageous
- Relevant certification / accreditation / membership with professional body as required for degree and/or role
- Fluent in English. Proficiency in other African languages/French advantageous
Experience:
- 5- 8 years’ experience in a regulatory affairs function/activity preferably in a telecoms environment
- 5 years’ progressive regulatory experience in telecoms environment including “hands-on” regulatory compliance strategy experience
- In depth experience and understanding of the ICT industry and regulatory framework
Effective stakeholder relationship management experience in a telecoms regulatory environment
- Strong and effective business communications (verbal and written) skills
- Worked across diverse cultures and geographies advantageous
- Experience working in a medium to large organization
