Our Capital Projects Commercial Management Office is hiring a Senior Manager, Commercial. Under the supervision of the Director, Commercial Management, leads and provides oversight of commercial governance and decision-making for the planning and delivery of the Lakeshore West Infrastructure Improvements Project (LSWIIP) within the division. This role will focus on strategic and transformational delivery of the project, including implementation of updates to the delivery model and building Metrolinx’s capacity to manage and deliver this large infrastructure project. Additionally, this role provides commercial options and strategic advice to the Director, Commercial Management and Vice President, Commercial Management, as well as other Metrolinx partners and leaders.

What will I be doing?
- Support the development and leads the execution of the overall strategy for commercial management of the Project Agreement with the Delivery Teams, Construction Manager, vendors and partners to ensure the successful delivery of the project and value for money objectives.
- Build and manages relationships with a broad number of internal and external stakeholders/partners, including the Construction Manager, 3rd party revenue partners, provincial/federal/municipal governments, agencies and/or communities, leveraging those relationships to advance commercial objectives.
- Manage, track and lead in the discussion and coordinated resolution of project commercial issues, supporting the Delivery Team while ensuring adherence to governance and policy requirements while keeping senior leadership and stakeholders informed.
- Provide overall commercial management and support of the LSWIIP Project, including adherence to the terms of the Project Agreement, tracking and managing Variations, Changes and Amendments, supporting and addressing issues related to invoicing and payments, and tracking and management of claim early warnings, clams and disputes on the project in adherence to the terms of the Project Agreement, Metrolinx policies and internal governance.
- Collaborate with delivery team members, internal stakeholders and partners in developing schedules and plans that maximize efficiency and timeliness; Partners and manages relationships with internal cross-functional departments (e.g. Sponsor Office, Legal, Operations, Capital Projects Group, Procurement, PRESTO, Finance and others) to ensure progression of project in achieving successful completion and delivery of the objectives and benefits.
- Develop components of procurement and/or contract documents, contract negotiation, governance and management strategies to ensure that contracts adhere to Metrolinx policies and procedures and to minimize corporate liability and risk throughout the contract lifecycle; Leads the review and analysis of the division’s/projects’ contract documents to ensure that the appropriate contracting strategy and contractual clauses are applied to reduce risk and protect the interests of Metrolinx.
- Develop assessments, materials and recommendations on commercial aspects, contract documents and approvals as required.
- Provide expertise in contractual interpretation and provides guidance to team members in the management of change orders, timing, notifications, and dealing with disagreements; Monitors contract amendments to ensure they are issued in writing and that negotiation and discussions are recorded.
- Effectively deals with significant commercial issues, including complex engineering, operational and business challenges to ensure the completion of key projects and strategies; monitors applicable regulations, codes and standards to ensure all legal obligations are met, or exceeded; facilitates collaboration and cooperation between stakeholders and external vendors to ensure project delivery and issues resolution.
- Manage processes, controls and measures to support the commercial management strategy, monitors and ensures contract compliance.
- Oversee and monitor progress of contracts to ensure that planning objectives are delivered on time and within budget, and that anticipated business results are achieved; monitors off-plan overages and exceptions; Manages the development of lessons learned to the benefit of Metrolinx on current and future contracts/agreements to reduce financial risk and liability.
- Identify emerging problems, reports contractual claims and supports the management and resolution of legal and/or commercial disputes involving Vendors.
- Advise and support on all matters of dispute resolution; provides strategic guidance in the preparation, settlement and agreement of commercial claims and disputes, and financial reconciliation of accounts.
- Administer all construction contract costs to ensure proper monitoring, control and review against approved budgets and ensures that financial status is accurately reported by the project teams, including adherence to guidelines from sponsoring government bodies.
- Support regular commercial project reviews including project performance, contractual issues, risks, mitigation strategies and lessons learned;
- Support and participate in meetings with partners, clients, vendors, etc. to discuss performance, common issues, and develop solutions.
- Completion of a degree in Applied Science, Engineering, Architecture, Business or a related discipline – or an equivalent combination of education, training and experience. Advanced degree is considered an asset, e.g., MBA.
- Prior demonstrated experience working in collaborative contracting models is considered an asset. (eg: Alliance, CMAR, CM, ,,,).
- Extensive experience in business roles related to the planning, procurement, design, and construction, including a experience managing large, complex, multi-year transit or infrastructure development projects.
- Experience commercially managing large infrastructure programs and alliance delivery models would be an asset.
- Experience in professional services and strategy consulting on large transformation and infrastructure projects would be an asset.
- Working knowledge of contract development process and commercial contract set up
- Demonstrated experience with collaborative and contract modelling
- Professional Engineer Ontario (P.Eng.), Certified Engineering Technologist (C.E.T.), Ontario Association of Architects (OAA), Project Management Professional (PMP), and/or Certified Construction Contract Administrator (CCCA) designation would be an asset.
- Strong oral and written communications skills.
- Strong strategic assessment skills.
- Canadian Rail Operating Rules (CROR) certification would be an asset.
- A valid driver’s license is required to travel to various project locations, public meetings, etc. (approximately 5%). Must meet and maintain the corporate standard for a good driving record.
- Knowledge of Contract Law, Canadian Construction Documents Committee documents (CCDC), Master Construction, Operating and Service Agreements, the Construction Act, Occupational Health and Safety Act, Environmental Assessment Act and the Professional Engineers Act, contracts documents, specifications and drawings, and legal statutes and proceedings.
