Conducts activities to manage and control all product and service agreement contractual and pricing-related activities. Develops, negotiates, implements and administers agreements with our customers. An essential aspect of this position is to facilitate 'win/win' agreements between our existing/potential customers, field sales/management, the dealer(s), and MillerKnoll (MK). Creates consistent, high-quality agreements which protect MK's legal, business, and financial interests; also balances those interests with being customer centered and oriented. Protects financial interests through careful analysis of a business opportunity and by using advanced problem-solving skills in contractual pricing decisions. Delivers specialized skills, knowledge, and consultation to field sales which enhances MK's competitiveness and likelihood of attaining volume and financial goals.  Manages process and ensures compliance with contractual obligations.

Key Accountabilities

  • Acquire and maintain an in-depth understanding of internal MK operating practices and computer systems.
  • Acquire and maintain an understanding of the contract furniture market selling practices, products, opportunities, competitive activity, pricing trends, and dealership and department capabilities.
  • Contribute to the development of strategies and processes to enhance revenue, profit and efficiency.
  • Act as a single point of contact with other MK departments and subsidiaries regarding contractual and pricing activities. Negotiate and document all agreements with these departments/subsidiaries that pertain to contractual commitments.
  • As a member of a negotiation team, help formulate strategy for fiscally responsible winning outcomes that balances the interests of all involved parties and achieves customer satisfaction.
  • Utilize financial, business, and organizational skills to develop creative and effective pricing proposals in dynamic and fast paced environments.
  • Conduct pre contractual research, analysis on past events/documents, and help develop contract negotiation goals and objectives that protect MK's legal, business, and financial interests; measure goals/objectives for performance.
  • Consult with legal team and other MK departments and subsidiaries to ensure that contractual terms and pricing are approved in accordance with corporate policy and accounting guidelines.
  • Consult with other MK departments and subsidiaries to influence new policy and change initiatives that may impact customer contractual relations.
  • Develop an "expert status" on all furniture industry contractual matters and MK operational matters.
  • Develop and nurture productive working relationships with regional sales personnel, e.g., field sales, sales management, dealer personnel, and other internal partners as needed to perform all essential duties.
  • Direct and manage the contract/ agreement development process and ensure the corporation's ability to comply with all promises, deadlines, and/or commitments made to customers or field sales. Deliver a complete, accurate, and professional contract/services agreement.
  • Direct and/or develop commercial subcontract service agreements with MK dealers and/or agents; ensure subcontract service agreements used are complete, accurate, and professional, and are issued in a timely fashion.
  • Lead the administration of all assigned contract and pricing commitments.
  • Initiate action with appropriate personnel to ensure internal partners are aware of, understand, and comply with all active contracts/services agreements. Provide risk assessments of the MK's contractual obligations and rights as requested by internal partners.
  • Keep other MK departments and/or subsidiaries informed on contract development progress and provide any needed documentation and consultation to same which ensures their compliance to all customer commitments.
  • Maintain a work-in-process contract/ agreement document control system; maintain all in process contract files/documentation in a consistent, orderly, and organized fashion. Ensure appropriate contractual documentation is provided for entry into storage system. Be prepared to provide a timely update on contract negotiations and/or contract status on an "as requested" basis.
  • Must develop finely honed contract management skills in a wide variety of service business situations.
  • Play a key role and/or lead team negotiations as appropriate; negotiation may be conducted face-to-face with customers or by telephone conference call. A contracts manager must be effective in both situations.
  • Understand federal procurement process and ensure compliance with Federal Acquisition Regulations (FARs), General Services Acquisition Regulations (GARS), and Defense Federal Acquisition Regulations (DFARS).
  • Responsible for signing GSA contracts, e-mods, teaming agreements, fees submission, etc.
  • Responsible for managing government contracts and requirements relating to BPA’s, Packaged Office Contract Holders, Teaming agreements, Letter of Authorization, etc.
  • Performs additional responsibilities as requested to achieve business objectives.

EDUCATION/EXPERIENCE PREFERENCES – Minimum Requirements 

  • Bachelor degree in a business-related field or applicable academic discipline.
  • 5-8 years' previous business experience with at least 3 years' of successful contracts work in a capital goods industry or professional services.
  • Familiarity with federal government procurement requirements, including socioeconomic programs, set-aside strategies, federal government procurement methods (BPA, IDIQ, Packaged Office), and teaming arrangements. Knowledge of current federal priorities, such as increasing small business participation, Buy American Act compliance, and CMMC is strongly preferred.

Skills And Abilities

  • Working knowledge of contract law and the Uniform Commercial Code.
  • Working knowledge of antitrust legislation, including Robinson Patman and Sherman-Clayton Antitrust Act.
  • Proven ability to interact effectively with others in an empowered team environment and use well developed problem dispute, and conflict resolution skills.
  • Strong interpersonal and human relations skills.
  • Excellent written and oral communication skills, particularly as applied to sales negotiations.
  • Proven analytical skills in pricing, finance and accounting.
  • Possess a high level of business acumen.
  • Strong organization, time management, and process management skills.
  • Ability to work effectively with different customer contacts, purchasing agents, attorneys, and facilities designers, and anticipate individual needs.
  • Must be able to effectively use office automation software and communication tools currently used in the MK office environment.
  • Must be able to perform all essential functions of the position with or without accommodations.
